These Terms of Service govern your use of the TellingCanvas website and our digital services. By using our website, contacting us, or engaging us for work, you agree to these terms. A signed proposal, statement of work, invoice, or client agreement may add to or override these public terms for a specific project.
Services
TellingCanvas provides professional website design and development, SaaS platform development, WordPress themes and plugins, browser extensions, API integrations, custom software, consulting, and related digital services.
Project Scope
Project scope, deliverables, timelines, fees, revisions, support, and ownership terms are defined in the applicable proposal, invoice, statement of work, or written agreement. Work outside the agreed scope may require a separate quote or written approval.
Client Responsibilities
- You are responsible for providing accurate project information, timely feedback, required content, brand assets, approvals, and access credentials.
- You confirm that materials you provide do not infringe another party's rights.
- You are responsible for reviewing and approving deliverables before launch or public use.
- You must not use our services for unlawful, harmful, abusive, or deceptive purposes.
Payments
Fees, deposits, milestones, due dates, and payment methods are stated in the applicable invoice or agreement. Unless otherwise agreed in writing, payments are due when invoiced. Late or unpaid balances may pause work, delivery, launch, support, or access to project files.
Timelines and Delivery
Estimated timelines depend on client feedback, content delivery, third-party services, technical review, and approval cycles. Delays caused by missing materials, unpaid invoices, third-party platforms, or scope changes may move delivery dates.
Intellectual Property
After full payment, you receive the rights described in the applicable project agreement. Unless otherwise agreed, TellingCanvas may retain ownership of pre-existing tools, reusable code, internal frameworks, templates, processes, know-how, and generic components used to deliver the project.
Third-Party Services
Projects may rely on hosting providers, payment processors, email providers, APIs, plugins, themes, marketplaces, or other third-party services. Those services are governed by their own terms, pricing, availability, and policies. We are not responsible for third-party outages, policy changes, security incidents, or discontinued features.
Confidentiality
Each party should treat non-public business, technical, financial, and access information as confidential. Confidential information may be shared with employees, contractors, or service providers who need it to perform work and are expected to protect it.
Portfolio Use
Unless a written agreement says otherwise, TellingCanvas may identify completed public-facing work in its portfolio, case studies, marketing materials, and capability presentations. Confidential or unreleased work will not be intentionally disclosed without permission.
No Guaranteed Results
We work to deliver professional, high-quality services, but we do not guarantee specific business, revenue, ranking, traffic, conversion, funding, or marketplace outcomes.
Disclaimer
The website and services are provided on an as-available basis. To the fullest extent permitted by law, TellingCanvas disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, TellingCanvas will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost revenue, or business interruption. Our total liability for a project will not exceed the amount paid to us for the specific service giving rise to the claim.
Termination
Either party may end a project according to the written agreement. If no agreement exists, either party may stop future work with written notice. Amounts due for completed work, third-party costs, and approved milestones remain payable.
